Kansas Attorney General Derek Schmidt has filed a federal lawsuit challenging the new federal vaccine mandate for Head Start programs.
Schmidt joined 23 other state attorneys general in filing the petition seeking to block the U.S. Department of Health and Human Services from implementing its mandate that staff, volunteers, and others who come in contact with Head Start students must receive COVID-19 vaccinations by January 31st.
The mandate also requires everyone at Head Start age two and up to wear a mask.
The filing asks the court to declare the mandate arbitrary, capricious, and unlawful under the federal Administrative Procedures Act.
The filing claims that the mandate will be detrimental to Kansans who rely on Head Start.
The petition states, “As a result of the Head Start Mandate, staff and volunteers will likely leave the Head Start program.”
